Hivebott General Terms of Service

Important Notice: This General Terms of Service Agreement ("Agreement") is established electronically between Hivebott ("Hivebott" or "Service Provider") and any natural or legal person ("Customer" or "User") who benefits from Telegram bot management services offered by Hivebott through the www.hivebott.com website.
By accepting this agreement, the Customer declares that they have read, understood, and accepted all service policies, supplementary agreements, and commitments of Hivebott.
1. Subject and Scope of the Agreement
This agreement regulates the terms of use and the rights and obligations of the parties for Telegram bot development, management, hosting, integration, and automation services provided by Hivebott.
2. Account Creation and Usage
The Customer must create an account with accurate and complete information to benefit from the services. Account security is entirely the Customer's responsibility.
3. Terms of Use
The Customer accepts and commits to the following:
- Being over 18 years old or having the authority to transact on behalf of a legal entity,
- Using the services in compliance with the laws of the Republic of Turkey, international regulations, and Telegram usage policies,
- Bots will not be used for spam messaging, fake followers/memberships, illegal content sharing, copyright infringement, misleading or harmful content publication,
- Bots will not engage in flooding, automatic spam, or user harassment activities in violation of Telegram API rules.
Otherwise, Hivebott may suspend or terminate the service.
4. Uptime and Service Continuity
Uptime Guarantee: Hivebott offers an annual system uptime guarantee of 99.8%.
Scheduled maintenance, Telegram API-related disruptions, force majeure events, and customer-caused issues are excluded from this guarantee. In case of guarantee violation, Hivebott may only provide a 5% service credit on the relevant service invoice.
5. Backup and Data Security
Backing up bot data is the Customer's responsibility. Hivebott provides automatic backup services only for support purposes. Hivebott is not responsible for any data loss.
The Customer accepts that all personal data processed within the scope of the service is processed in accordance with KVKK, GDPR, and relevant legislation.
6. Support Services
Support is provided through support channels determined by Hivebott (ticket system, email, customer panel).
Requests for third-party software integrations outside the Telegram API or customer-specific configured systems are outside the scope of support.
7. Payment and Refund Terms
- All services are prepaid.
- Payment can be made by bank transfer, credit card, or alternative methods offered by Hivebott.
- Refunds are only provided if the service has not been used at all and only at Hivebott's discretion.
- No refunds are given for used services.
- Prices may be changed without prior notice.
8. Service Suspension and Termination
Hivebott may suspend or terminate the service in the following cases:
- Non-payment
- Use of Telegram bots for spam, illegal content, or user harassment
- Breach of contract
- Request from authorized institutions
9. Privacy and Data Protection
Hivebott uses customer information only for service delivery purposes and does not share it with third parties except in cases of legal obligation under KVKK. Data may be provided to official authorities upon necessary information requests.
10. Force Majeure
Unforeseeable and unavoidable events such as Telegram API access issues, earthquakes, wars, pandemics, cyber attacks, and government intervention are considered force majeure.
Hivebott is not liable during force majeure. In cases exceeding 30 days, parties have the right to unilateral termination.
11. Limitation of Liability
Hivebott cannot be held responsible for the following:
- Indirect damages
- Loss of income
- Data loss
- Disruption of customer business processes
- Third-party claims
Maximum liability is limited to the amount paid for the relevant service.
12. Indemnification
If the Customer acts in breach of contract in a way that will harm Hivebott or third parties, they agree to compensate for all damages that may arise.
13. Transfer of Service
The Customer cannot transfer their services to a third party without Hivebott's written consent.
14. Contract Duration and Amendments
This agreement is valid from the date it is electronically accepted by the Customer.
Hivebott reserves the right to amend the agreement. Updates take effect when published on the website.
15. Dispute Resolution
Izmir Central Courts and Execution Offices have jurisdiction over all disputes arising from this agreement. Turkish Law applies to disputes.
16. Partial Invalidity
The invalidity of any provision of the agreement does not affect the validity of other provisions.
